FY26 Recording and Reporting Federal Interest (11/3/2025)

The Elementary and Secondary School Emergency Relief (ESSER) Fund (i.e., ESSER 2.0, and 3.0) allowed Local Education Agencies (LEAs) to use federal funds for construction activities and facilities improvements, providing many LEAs the opportunity to make critical investments in infrastructure and improvements to the quality and safety of their schools.  

LEAs that have undertaken ESSER-funded construction projects are required by federal regulation to file an annual report on the status of each real property in which ED retains an interest (i.e., each property on which ESSER-funded construction is in process or has been completed).

Additionally, projects funded by ESSER in the amount of 1 million dollars or more must record a Notice of Federal Interest (NFI) in the official real property records for the jurisdiction in which the facility is located.

An FY26 Recording & Reporting Quick Guide, as well as an FAQ document, are now available in TDOE Resources. Additionally, the Relief Team will conduct a webinar on Wednesday, Nov. 12, at 9:00 a.m. CT | 10:00 a.m. ET to further discuss the Reporting of Federal Interest.

Significant Disproportionality Determinations (10/31/25) (10/31/2025)

Local education agency (LEA) determinations for significant disproportionality are now available for review in the FY26 LEA Document Library. LEAs identified as having a significant disproportionality that do not request an appeal will need to submit the Significant Disproportionality Acknowledgement Form by November 7, 2025. If an LEA would like to appeal the determination, the Significant Disproportionality Appeal Form must also be submitted by November 7, 2025. 2025 LEA Compliance Report (10/2/2025)

Local education agencies (LEAs) are required to comply with all federal and state education laws and State Board of Education (SBE) rules. The department is responsible for ensuring school laws and SBE rules are executed or implementing corrective action if an LEA is noncompliant with the laws and rules or is not following a department-approved compliance plan. 

The LEA Compliance Report is a document used by the department in its annual process of ensuring compliance. All LEAs are required to complete the report, including the corrective action plan template, if applicable, and upload it to ePlan (ePlan Submission Instructions) by November 28.  

IDEA Parentally Placed Non-Public School Reserve Calculation (10/1/2025)

Federal regulations require that a proportion of federal funds be used to provide services to children with disabilities in private schools. The IDEA Parentally Placed Non-Public School Reserve Calculation report will open in ePlan on Monday, Dec. 1, 2025, and must be completed and submitted by Monday, Jan. 12, 2026. Directors of Schools and Special Education Directors have access to submit the report.

Carryover and Expiring Funds Review in ePlan (8/15/2025)

The FY26 Carryover and Expiring Funds Review data and information instrument is now available in ePlan. This instrument provides an overview and acknowledgement of FY25 and FY24 grant remaining grant balances. LEAs are responsible to ensure that funds are spent during the grant period - including meeting carryover limitations.

Data will be provided for LEA review on the schedule below. Most data updates are review only and no action is needed from the LEA within the ePlan instrument. Two acknowledgement pages (August 15 and November 14) require either the LEA Authorized Representative or the LEA Fiscal Representative to acknowledge that they have reviewed the data and understand the LEAs obligation requirements.

Carryover (FY25) and Expiring (FY24) Funds Updated:
